By accessing or using DescribeThis.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service, and old enough to form a binding contract under the laws of your jurisdiction. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

DescribeThis.ai is provided for personal and professional creative use. You agree to use the Service in a way that is lawful, respectful of others, and consistent with these Terms. In particular, you agree not to:

• Use the Service in violation of any applicable law, regulation or third-party right.
• Attempt to bypass, disable, or interfere with rate limits, moderation, security features, or any technical restrictions.
• Scrape, automate, or programmatically extract content from the Service without prior written permission.
• Attempt to reverse-engineer the AI prompts, infrastructure, or internal logic of the Service.
• Use the Service to develop a competing product or to train another machine-learning model.
• Misrepresent generated outputs as the work of another person or as a non-AI human creation in contexts where that misrepresentation would mislead or harm someone.

You agree not to upload, submit, or otherwise process any image that contains:

• Sexual, pornographic, or sexually suggestive content, including non-consensual or AI-generated explicit imagery.
• Sexual content involving minors, or any content that sexualizes minors in any way.
• Graphic violence, gore, or content glorifying real-world violence or terrorism.
• Hate symbols, hate speech, harassment, or targeted abuse of a person or group.
• Content depicting or promoting self-harm or suicide.
• Content that infringes the intellectual property, privacy, or publicity rights of others.
• Personally identifying information about other people uploaded without their consent (e.g. ID documents, private medical images).
• Malware, exploits, or content designed to disrupt or compromise systems.

All uploads pass through automated moderation. Violating uploads are rejected and may result in temporary or permanent blocking of your access. Repeated or serious violations may be reported to the relevant authorities.

The Service applies per-visitor limits — currently 15 uploads per day, a 30-second cooldown between uploads, and up to 20 section regenerations per day. These limits keep the Service fast and free for everyone and may change without notice.

Attempting to circumvent rate limits (for example, by rotating IPs, automating browsers, or abusing the regeneration endpoint) is a violation of these Terms.

You retain all rights you already have in any image you upload. By uploading an image, you confirm that you own it or have the necessary rights and permissions to process it through an AI service.

You grant us a limited, non-exclusive, royalty-free license to process the image solely for the purpose of running moderation and returning your results. This license ends as soon as your results are returned and the image is discarded.

Prompts, descriptions, captions, vibes and hashtags are generated by AI models. We make no claim of ownership over the outputs returned to you, and to the extent permitted by law you are free to use them.

AI outputs can be inaccurate, incomplete, biased, or occasionally surprising. You are responsible for reviewing and editing them before publishing, sharing, or relying on them. Do not use outputs to make important decisions (medical, legal, financial, safety) without independent verification.

Identical or similar prompts may produce similar outputs for other users; AI-generated text is not guaranteed to be unique.

The Service — including its name, branding, design, code, copy, and the curated example content on this site — is owned by us or our licensors and is protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works of the Service itself without permission.

The Service uses third-party AI providers (such as OpenAI via the Lovable AI Gateway) for image understanding and content generation, and may use third-party infrastructure for hosting, analytics and abuse prevention. Your use of the Service is also subject to those providers' applicable terms.

The Service is provided on an "as available" basis. We may add, modify, suspend or remove features at any time, and we may temporarily pause the Service for maintenance, upgrades, or to respond to abuse. We may also update these Terms; material changes are reflected in the "last updated" date above.

You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your use of the Service, your uploads, or your violation of these Terms.

These Terms are governed by the laws of the jurisdiction in which the operator of the Service is established, without regard to its conflict-of-laws rules. Any disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer-protection rules in your country apply.
